SEMINARS DO NOT PROVIDE MEDICAL ADVICE
The contents provided during DRSPECTSCAN.COM Webinars, such
as texts, graphics, images, information obtained from the
site’s licensors, participating speakers, including
licensed physicians, and other material contained on the
DRSPECTSCAN Site and Webinars ("Content") are for
informational purposes only. The Content is not intended
to be a substitute for professional medical advice, diagnosis,

either by DRSPECTSCAN employees, others appearing on the

CONTENT
DRSPECTSCAN authorizes user to view or download a single
copy of the material provided during a Webinar or otherwise
on the DRSPECTSCAN site solely for personal, noncommercial
use and that user maintain any and all notices contained
in the Content, such as all copyright notices, trademark
legends, or other proprietary rights notices. Any special
rules for the use of certain software and other items accessible
on the Site or during a Webinar may be included elsewhere
within the Site and are incorporated into these Terms and
Conditions by reference.
DRSPECTSCAN Webinars and/or web site contain Content that
is protected by copyright, trademark, trade secret, or other
proprietary rights under United States laws. DRSPECTSCAN.COM
and/or J. Michael Uszler, M.D., Inc., own a copyright in
the selection, coordination, arrangement, and enhancement
of such Content. User may not modify, remove, delete,
augment, add to, publish, transmit, participate in the transfer
or sale of creative derivative works from, or in any way
exploit any of the Content, in whole or in part. Title to
the Content remains with
DRSPECTSCAN.COM and/or J. Michael Uszler, M.D., Inc., or
its licensors. User may not upload, post, reproduce, or otherwise
distribute in any way Content protected by copyright, or
other proprietary right, without obtaining permission of
the owner of the copyright or other proprietary right. Additionally,
use of any software Content shall be governed by the software
license agreement accompanying such software. Any use of
the Content not expressly permitted by these Terms and Conditions
is a breach of these Terms and Conditions and may violate
copyright, trademark, and other laws. Content and features
are subject to change or termination without notice in the
editorial discretion of DRSPECTSCAN. All rights not expressly
granted herein are reserved to DRSPECTSCAN and its licensors.
If you violate any of these Terms and Conditions, your permission
to use the Content automatically terminates and you must
immediately destroy any copies you have made of any portion
of the Content.
TOOLS
DRSPECTSCAN may make available on the Site and/or during
a Webinar products, tools and utilities for use and/or download
(the “Tools“). DRSPECTSCAN and/or J. Michael
Uszler, M.D., Inc., does not make any assurances with regard
to the accuracy of the results or output that derives from
such use of any such Tools. The Tools are copyrighted works
of DRSPECTSCAN and/or its suppliers, and are protected by
copyright law. If a Tool is accompanied by an end user license
agreement, your use of that Tool is governed by the terms
of such end user license agreement, and you must agree to
the terms and conditions of such end user license agreement
in order to install such Tool. If a Tool is not accompanied
by a license agreement, DRSPECTSCAN hereby grants to you
a revocable, personal, non-transferable license to use such
Tool in accordance with these Terms of Use and for no other
purpose. Without limiting the foregoing, any reproduction,
redistribution, reverse engineering or decompilation of the
Site or the Tools is expressly prohibited by law, unless
such action is expressly permitted by the accompanying license
agreement, and may result in severe civil and criminal penalties.
You agree not to redistribute the Tools, nor to export or
re-export the Tools, directly or indirectly, to any countries
that are subject to USA export restrictions. You may not
use the Tools to defame, abuse, harass, threaten or otherwise
violate the legal rights of others. You may not use the Tools
in association with the sale of any service or product which
is indecent or unlawful.

The use of the DRSPECTSCAN Site, Tools and Content provided
during a Webinar, or found on the web site generally, is
at your own risk.
When using the site, or during a Webinar, information will
be transmitted over a medium that may be beyond the control
and jurisdiction of DRSPECTSCAN and/or J. Michael Uszler,
M.D., Inc., and their suppliers. Accordingly, DRSPECTSCAN
and J. Michael Uszler, M.D., Inc., assume no liability for
or relating to the delay, failure, interruption, or corruption
of any data or other information transmitted in connection
with use of the Site or Webinar.
The Content and Tools are provided on an "as is" basis. DRSPECTSCAN,

SPEAKERS, AND ITS SUPPLIERS, TO THE FULLEST EXTENT PERMITTED
BY LAW, DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED,
STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE
IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT
OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE. Without
limiting the foregoing, DRSPECTSCAN and J. Michael Uszler,
M.D., Inc., its licensors, participating speakers, including
licensed physicians, and its suppliers make no representations
or warranties about the following:
1. The accuracy, reliability, completeness, currentness,
or timeliness of the Content, software, text, graphics, links,
Tools or communications provided on or through the use of
the DRSPECTSCAN Site or Webinar.
2. The satisfaction of any government regulations requiring
disclosure of information on prescription drug products or
the approval or compliance of any software tools with regard
to the Content contained on the DRSPECTSCAN Site or Webinar.
In no event shall DRSPECTSCAN and/or J. Michael Uszler,
M.D., Inc., its licensors, participating speakers, including
licensed physicians, its suppliers, or any third parties

liable for any damages (including, without limitation, incidental
and consequential damages, personal injury/wrongful death,
lost profits, or damages resulting from lost data or business
interruption) resulting from the use of or inability to use
the Site, the Tools or the Content, whether based on warranty,
contract, tort, or any other legal theory, and whether or
not DRSPECTSCAN and/or J. Michael Uszler, M.D., Inc., its
licensors, participating speakers, including licensed physicians,
its suppliers, or any third parties mentioned on the DRSPECTSCAN
Site or during a Webinar are advised of the possibility of
such damages. DRSPECTSCAN and/or J. Michael Uszler, M.D.,
Inc., its licensors, participating speakers, including licensed
physicians, its suppliers, or any third parties mentioned
on the DRSPECTSCAN Site or during a Webinar are not liable
for any personal injury, including death, caused by your
use or misuse of the Site, Tools or Content. Any claims arising
in connection with your use of the Site, or any Content must
be brought within one (1) year of the date of the event giving
rise to such action occurred.

CANCELATION/REFUNDS
All Online course charges/payments are NON-REFUNDABLE, and
NON-EXCHANGEABLE. NO money will be credited to
future DRSPECTSCAN.COM events and/or Webinars, NO refunds
will be given for unused services and NO claims of any kind
for refunds will be accepted. If you do not attend
you are responsible for the entire payment.
MODIFICATION/DISCONTINUATION
The DRSPECTSCAN site reserves the right at any time and
from time to time to modify, edit, delete, suspend or discontinue,
temporarily or permanently this Site (or any portion thereof)
and/or the information, materials, products and/or services
available through the DRSPECTSCAN site or Webinars (or any
part thereof) with or without notice. You agree that DRSPECTSCAN
shall not be liable to you or to any third party for any
such modification, editing, deletion, suspension or discontinuance
of this Web Site.
INDEMNITY
You agree to defend, indemnify, and hold DRSPECTSCAN web
site and J. Michael Uszler, M.D., Inc., its officers, directors,
employees, agents, licensors, and suppliers, harmless from
and against any claims, actions or demands, liabilities and
settlements including without limitation, reasonable legal
and accounting fees, resulting from, or alleged to result
from, your violation of these Terms and Conditions. You
shall cooperate fully in any defense of such claim. DRSPECTSCAN.COM
reserves the right to control the defense of any such claim.
JURISDICTION
You expressly agree that exclusive jurisdiction for any
dispute with DRSPECTSCAN and J. Michael Uszler, M.D., Inc.,
or in any way relating to your use of the web site and/or
Webinars, resides in the courts of the State of California
and you further agree and expressly consent to the exercise
of personal jurisdiction in the courts of the State of California
in connection with any such dispute including any claim involving
DRSPECTSCAN web site, J. Michael Uszler, M.D., Inc., or its
affiliates, subsidiaries, employees, contractors, officers,
directors, telecommunication providers, and content providers.
These Terms and Conditions are governed by the internal
substantive laws of the State of California, without respect
to its conflict of laws principles. If any provision of these
Terms and Conditions is found to be invalid by any court
having competent jurisdiction, the invalidity of such provision
shall not affect the validity of the remaining provisions
of these Terms and Conditions, which shall remain in full
force and effect. No waiver of any of these Terms and Conditions
shall be deemed a further or continuing waiver of such term
or condition or any other term or condition.
COMPLETE AGREEMENT
Except as expressly provided in a particular "legal
notice" on the DRSPECTSCAN Site, these Terms and Conditions
and the DRSPECTSCAN.COM, and J. Michael Uszler, M.D., Inc.,
Privacy Policy and Agreement constitute the entire agreement
between you and DRSPECTSCAN.COM, and J. Michael Uszler, M.D.,
Inc., with respect to the use of the DRSPECTSCAN Site,
Webinars and Content. |
